This presentation will concentrate on Title VII of the Civil Rights Act, as amended, and Chapter 21 of the Texas Labor Code, to include the exhaustion of administrative remedies, the affirmative defense under Faragher/Ellerth, and removal of a case to federal court. Clara will also provide some personal experiences.

Clara Luna Buckland, CP, AWI-CH (Paralegal Division Ambassador @El Paso Electric Company)

Clara is a NALA Certified Paralegal, and an ANSI Accredited Association of Workplace Investigators Certificate holder. Prior to her work with El Paso Electric Company, Clara worked as a paralegal in the specialty area of Labor and Employment Law at Kemp Smith LLP, for 17 years. Prior to that, Clara worked as a Family Law paralegal for five years with Kathleen C. Anderson Law Offices.

Today, Clara works in the Office of General Counsel of the El Paso Electric Company as a paralegal and inhouse Legal Investigator handling employee EEO related complaints. Clara also assists in responding to the US EEOC’s Request for Information and submitting the Company’s Statement of Position. Clara represents the Company’s interests in claims for unemployment insurance benefits and represents the Company before the Appeals Tribunal, handling contested case hearings on unemployment decisions in Texas and New Mexico.

In her role as a paralegal, Clara works closely with outside counsel on matters in litigation and prepares the company’s first draft responses and objections to all written discovery, to include assisting outside counsel as needed through the litigation process, to conclusion.

Member of the Association of Workplace Investigators that serves over 900 members internationally.
