Description:  The presentation will discuss why retaliation is a prevalent claim filed by Plaintiffs; the standard (i.e. what standard is the standard that must be shown by a plaintiff to establish a retaliation claim and the relevant definitions of the terminology included in the standard); a brief discussion of discrimination and the standard to show that the standard for retaliation is easier to satisfy making it prevalent in employment actions; case law discussion.
